Having trouble with the package firmware-linux-nonfree_0.21.all.deb

I'm seeing errors both in smxi and in Synaptic, in both cases I get a failure"trying to overwrite '/lib/firmware/tigon/tg3_tso.bin' which is also in package firmware-linux-free
So I tried moving said file but still get the error.

Do I need to remove the free version to get nonfree?
Other ideas?
